refresh rate problem

I have a geforce 4 ti 4400 with all the latest drivers installed + dx9 (CRT) set to refresh at 85 hz (desktop). My problem is when I enter games the refresh rate changes back to 60 hz, also vsync is off.
 
I thought the new nvidia drivers fixed winxp refresh rate being capped at 60 hz
 
Never seen this actually be fixed. I would just start googling for answers- that's what I have to do when I lose whatever proggy I was using last. what Im using right now is called 'RefreshLock,' and it does the job perfectly.

edit: the new version of refreshlock appears to be linked above. that's what I get for being lazy.
