Join the club. That's what annoys me about Heatware - you don't have to link to the original F/S thread, so anyone can leave you a nasty eval for no reason. I apparently also sell "dead" unspecified video cards.

capper, dude I and a few others warned everyone in that thread not to ship first. But I still hate to see honest people learn the [H]ard way.

I feel so bad for you guys. WHats his address, please make it public

Talked to his 80-something Grandfather today...at the phone # and address I was given. He has now left and they have no way of contacting them...which I find hard to believe.
Here is the shipping information and phone # I was provided.

[personal info edited out]

Does anyone else have any other contact infor for him? [removed]

wow. what a prick. on the run now. too bad its near sacremento...i'm in so cal.

according to Grandpa, he intends to ship everyones stuff when he gets home (whereever that is), so there is a big discrepancy...My stuff was supposed tro have shipped last Friday, he even called Monday morning to see if i had gotten it. His Grandfather said that he doesn't even have the stuff there, so there was no way it could have shipped.
Have called the Sacramento Ca Sheriff and filed a complaint with the High Tech crimes unit, and the Internet Fraud people at IC3.gov....any other ideas?

There was a thread recently where people showed up at the troll's house and it scared the shit out of him. Needless to say, the money was refunded... ;)

I even hate to suggest this, so I'll preface this by saying use your judgement based on your communications thus far...

After to talking to each of the grandparents, if you have the impression that they're covering for him in any way (which it sounds like from your post), you can put a little scare in them since it sounds like he used their internet access and/or physical shipping address for this fraud, correct? Sounds harsh to 'bully' a couple of senior citizens, but if they're protecting him after frauding $600+ worth of goods, then they are in the wrong as well.

So, since he seemingly lives elsewhere, I'd be trying to get that information from the grandparents (if the police aren't already on top of this). I'd also contact an admin here and see what info they can derive from the IP(s) he's logged into the forum with. That may or may not lead to something.

Aside from the above, it's kind of a wait and see thing with the local authorities.

Capper, be careful with this approach. Especially with having the authorities involved, if a confrontation got out of hand, that could come back to haunt you. See above - I'd continue to pester the grandparents and the authorities.

The grandparents are involved, but not directly responsible for this jerk or his actions. Even pestering them may get YOU in trouble. Cops I've known usually will go after someone young bugging the elderly...even if the young person is right in doing so.

Were supposed to be heading down in a few weeks to visit family,( Im from oak park). I got hurt at work but if we still go Id be happy to stop by with my brothers and some friends.

although im one of the involved parties (im short a powerbook thus far) i am not considering any personal threats. Things happen and irresponsible people will always infect credible boards such as this one. I dont think its in the best interest to be "stopping by" or even making an assumption or joke about it because it will make for things to be very difficult if the law is to get involved (which dear god i hope it doesnt, i just want my MO)

No, no ,no.... I in no way made a threat...but if you stop by and say "Hey, I'm the guy who was wronged here", and show them copies of emails, shipping invoices, etc...then you have alot more substance then someone on a phone or email.
Sorry if tyhat came across wrong, but I'd be happy to print things out if someone happened to be in the hood and could stop by.
As to posting his info...I don't see the problem...After ripping me and others off, this assclown was allowed to remove all his contact information and close his threads...not really right if you think about it.

Let me also make it clear that his Grandparents did nothing wrong and aren't responsible for this kid in any way. I understand he used their computer, etc...but they didn't twist his arm on this. I also found out he doesn't live there with them, but lives in Santa Cruz with his father

The problem with posting a person's address is you can put them in danger. All it takes is for one overzealous, mentally imbalanced forum member that lives within a reasonable vicinity or embarking on a road trip to take that information and create a serious situation. It also puts other residents at or near the address in danger, as you don't know if it contains roommates, unwitting family members, children, etc.

As unfortunate as it is to get scammed, it's not appropriate to put that person and unforeseen others in a potentially harmful situation. Getting the authorities involved, as you have done, is correct path to pursue.

Finally, I would reiterate against having someone stop by his address for you. I understand where you're coming from and the frustration, but you're taking a risk in having someone impersonate you and hoping an unfavorable confrontation doesn't develop as a result. Cablebox could get mouthy, may have a friend or two with him at the time, and you can see where I'm going with this. An insult could turn into a shove could turn into...

Just think it through Capper, and all the potential variables. I would hate to see an unfortunate situation turn worse and backfire, ya know?

Yeah my bad... i didn't figure in the "mentally imbalanced forum member"....I think we all fit that title in a sense......I didn't think about it and just posted it because someone asked for it... I also thought, saying how things have gone, that there are probably other addresses out there for him

Another thing that bugs me...after talking to his Grandfather, who said they had no idea how to contact him....I talked to his grandmother who told me he lives in Santa Cruz with his father. She again asked me to wait another da and not get upset....believe me when i say this I am very nice and respectful when addressing her....i'n not psycho or anything, but there are just too many discrepancies with his and their stories..... I'm at a loss here.

I feel completely the same way...but I've been hearing the exact same thing since Friday. I also think hisd granmother is very nie, and can understand them protecting him.
I feel as though we are just being "appeased" though.
i just want my damn video card, and would have been very willing to work with the kid had he been honest instead of the lies and BS games...I'm actually a very nice guy....at least I think i am.

Well...so much for that...He's been online for about 15 minutes and is totally ignoring my Ims.......This kid just has no clue...Does anyone else know him? Can anyone else try to reason with him and tell him how wrong and serious this is? Any intervention would be greatly appreciated

Its like a 4-6 hour drive for you right? Shit, for $620+, i'd go over there myself.

No...I can see where the guys are coming from. Someone asked me to post his name and address....I thought it would be to help track him down...but I totally see the point.
Its almost 8 hours from me.
Whats funny is he is online right now...but won't answer me...he popped up once and said 'I'm not ignoring you...I'm on crappy wireless" Then he signed off.
Damn...i don't want to be the bad guy here, but he is kinda forcing my hand. Noty a good way for a 19 yr old kid to start off.

caught him online early this morning....I told him "Richard, this is serious, we need to solve this problem".....his reply? "Sorry, clan practice"

And how is a video more important then r/l legal trouble?

Anyhow 19yo, don't matter if he does it to you what could stop him from doing it to others?

Also a small note, never go alone always have witnesses.

I didn't evan read the last few sentences of your post (orignal post)

But you are *dumb* for dealing with someone who had complaints from people for NOT shipping, and EVEN DUMBER for agreeing to ship first/same time, and especially for $600 worth of stuff.. I don't mean to but rude or anything, but common sense man. Go to his house and kick his fuckin ass, thats what I would do..

goodLuck

uhhh..try reading the whole thing, and also look at dates and times...Mine was the first problem....wanna talk dumb

After agreeing to a deal, "cablebox" insisted on me shipping first....

Why would you agree to ship first if others crapped on his (FS/FT) threads for ANY reason..?

I don't want to be mean because I know you must be in a bad mood after all this.. but seriously..

two people crapped on his thread.....for no reason. Me, and another person said to give him a chance...my bad.
Hell, I don't have any "heat", but alot of people know and would vouche for me, i used to trade on EBay (and have alot of positive feedback)...but everyone deserves a chance...in hindsight...I made a mistake...but you aren't helping or trying to solve the problem...... if you don't have anything constructive to add, move along.

Capper, have you given the police his updated address information (his father's residence)? In addition, have you contacted a mod to see if they can trace his IP?

The kid is stalling and if he had a genuine interest in resolving the issue, he would be communicating and apologizing. You really ought to get proactive with the local authorities and ask them for an update, see what progress has been made on their part.

This is for the benefit of all members here:

If you have been scammed and have the other party's name, address, and telephone number, then I suggest you go through and file a complaint through small claims court. it's quick, easy, you don't need a lawyer, and does not cost much money.

The problem with continually attempting to contact the other party is that they could turn around and file a harassment complaint against you, especially if you or any other [H] member here decides to go pay them a visit.

At least with small claims court, if they do not show up, then a warrant would be issued for their arrest and they would be placed in jail until the next scheduled court date.

This information is solely based on my own past experiences of running my own business and having to collect outstanding debts. I find that once a person receives an official court summons they will go out of their way to resolve the situation instead of facing a judge.

If you do go this route and the other party wants to make good and avoid going to court, then make sure the problem is resolved (aka you have your money, product etc) *before* dropping the court case.

He can sue you and [H]ard - that's the more realistic issue. 5th Amendment and all that.

That's what the they're there for and you pay taxes to. Use them.

Being innocent of having someone steal from you is not a crime. People shouldn't have to protect themselves from scum. That slime is the only person who deserves to be punished.

TROLL

/thread :p

this guy is obviously a troll..so can we get a ban on him (or at least his second account) and label him a bad trader?

ppl like him disgust me

ive never been trolled..but ive had one guy, his heatware is anaphora, who emailed me (no PMS sadly..that was my fault for not telling him to PM me, so i dont have his [H] name) saying he would take the ram i was selling for $20 less than what i wanted (i wanted to sell 2 out of the 3 sticks i had and i told him a fair price (already about $30 less than the newegg price) for all 3 sticks so i could buy another 512mb stick for myself.... he tells me he wants another $20 off or no deal....then i say no and he leaves me bad heat for "selling" him a dead 9800pro...

please..ive never even SEEN a 9800pro in real life, let alone sell one :(

my heats 4b5eN+EE BTW

Boy,both of those negatives seem unwarranted to me.That one about the MB sounds like someone that screwed up and wanted you to pay for it,it's an example of why I get nervous selling stuff online, too many idiots although they're in the minority luckily.

Oh,and good luck capper,I knew that guy was bad news when he was selling a card that wasn't even made by Visiontek.

One would need to check with their local courthouse for the specific steps, paperwork, and costs involved. I know here in NJ, the procedure and costs are the same throughout the state.

You cannot file with a small claims court across state lines. it would require me going to his home town, putting out the $50 filing fee and waiting. which would mean a hotel for awhile, or more trips there.
The reason I posted his information was I only have the address where he was staying in Fair Oaks...whats strange about that is if you look up his name, his address is there in Fair Oaks and its his phone number, which doesn't make sense if he is just staying there). I do not, nor will his family give me, his current contact information. I have no way of communicating with him other than through AOL, and when I sign on, he signs off. Now when I call the number I was given, I get a voice message from someone named Glenn Devery??!!
I have filed a report to trollhunters.com, the FBI fraud unit, his local, PD (at his families address), etc. I also sent Kyle an email so he hopefully provide an IP or something for this guy.

Have you even called the County Clerk's Office to find out? You *do not* necessarily have to go to his town to file. Here in NJ I can submit a small claims court case through the mail.

Some areas *allow* small claims cases to cross state lines. Each area is different in their procedures, you have to *call* to find out what you are able to do and not do.

CA and NV do not allow out of state filings..i have already checked. i would need to go to his county and file...and now since i have no hard address for him, and his Grandparents are not helping...I'm kinda floundering here.
Heres hoping Kyle and trollhunters.com can come through with the information so I can pursue this.

damn, Capper. Hopefully the authorities come through on this guy, that would be sweet justice. Might I suggest something: since you are only able to contact him through AIM, why not get some sort of AOL IM logging program, such as deadAIM. It might not be a bad thing to be able to prove all the attempts you made to contact him in this fashion, as it logs time and everything.

May the flees of a thousand camels infest his underarms and groinal region!

LMAO...thats good rook. I thought AOL automatically kept a log of all your IM's... I usually use Trillian, but recently switched...
LOL, he's on right now, and won't respond to my IMs
anyone else want to try? It's "CrutchesY2K".
I think what put me over the edge was asking him what they story was, and having him say "Sorry, clan practice".
C'mon Hard Mods, wanna try to help here? Jesus.

Can you have someone help you file? Like say contact them, file the claim with their address and when you need to go they'll contact you and go with you to court.

I don't know about that. My wife is involving a lawyer friend now....I want this kid to pay big time....and as to sweet old Granny, she was just stalling for him. I called her tonight as we agrred to talk...and they have an answering machine turned on to pick up without it ringing....the name on the machine is "Glen Devery" which is pretty strange.......just an all around bad situation, one F$cked up family.
I wanna know if the other guy got his lappy back or the money he was promised
